The garage within the boundary of the property was built in 2001 and in the planning permission granted at the time (Ref: 0101909FUL, Case no: W17374) a stipulation was included that the garage should be used ?solely for the accommodation of private motor vehicles or domestic storage, and not as living accommodation or for business use.? This has come to light as we are in the process of selling the house, and has been picked up and brought to our attention by the buyers? solicitor.It transpires that the previous owner of the house converted the garage into a playroom and hangout space for her children and a temporary dark room for hobby photography in around 2006, but did not apply for any change of use or apply to have the stipulation removed.When we purchased the house, we were unaware that there was a planning stipulation on the garage, and we carried out a programme of renovation of the garage to include a shower room and utility area, along with a garden room. Our refurbishment works involved no structural or material change of use, and were signed off by Building Control as compliant with current standards. We were advised that these refurbishment works fell under permitted development.We are therefore requesting that a lawful development certificate be issued to waive the section 3 condition of planning restricting the use of the garage.
