Following investigation as to the extent of the curtilage at Ladywell Lakes by the planning department in Winchester it has transpired that in 1989 when the 5 acre plot on which Ladywell Lakes stands was granted planning permission, there is no evidence that can be found that an application to change use from a fishery to residential was officially made. The issue with the change of use only relates to a portion of the plot which is outside the curtilage of the house. (The curtilage has finally been identified as being around the area near the site, covering approximately 40% of the large garden). This application is therefore made to regularise the position, without admission that the original permissions were not validly obtained in 1989. The plot was conveyed in 1987 from Arle House to Mr and Mrs Ng. Part of the plot had been used as a fishery in the 1970s. In 1989 an application to build a dwelling house and garage (with flat above) on the whole plot was granted. The house was completed in 1990 and Mr and Mrs Ng lived in the property from 1990 until 2017, when it was sold to the Applicant, Lucy Greenwood, and her husband, Paul Greenwood. The house and garden are enclosed by hedging/fencing which has not changed since the plot was conveyed in 1987. Garden sheds and a small summerhouse are located in the garden, together with a treehouse and tennis court. There are seating areas beside the two lakes and a vegetable garden. There is a drive and a gate at the end of the drive. Due to the size of the garden, from completion of the house, Mr and Mrs Ng employed a full time gardener who lived in the flat above the garage. Mr Alastair Hodge moved into the flat to work as a gardener in early July 2013, taking over from the previous gardener. Mr Hodge has provided a declaration demonstrating that, throughout his time, the plot was never used for any purpose other than as a residential garden. He continues to work for the Applicant and her husband....
