Description

On 27th June 2013 planning permission P13/V0512/HH was granted for the following development: "Conversion of storage space above garage for ancillary residential accommodation (retrospective)" subject to conditions. For the avoidance of doubt the building which is the subject of this permission is shown in the approximate location edged blue on the Plan. Condition 1 of the planning permission P13/V0512/HH requires the following:- "The additional residential accommodation hereby permitted shall be occupied only as accommodation ancillary and incidental to the existing dwelling on the site and shall not be occupied or used separately, and no separate curtilage shall be created. Reason: The additional accommodation and the existing dwelling would not enjoy reasonable standards of residential amenity if occupied separately (Policies H19 and H24 of the adopted Local Plan)." It appears to the Council that the condition has not been complied with because the additional residential accommodation permitted by planning permission P13/V0512/HH above the garage has been expanded into the ground floor garage space, facilitated by a ground floor kitchen and an internal staircase and the building is now occupied by the owner and his wife as their principal dwelling in a manner that is separate from and not ancillary or incidental to the existing dwelling.
