For Wandsworth Borough Council (Council) to enter into two agreements (the Phase 6 Section 106 Agreement and the Phase 7 Section 106 Agreement) with Battersea Project Land Company Ltd and Battersea Project Phase 6 Company Limited in respect of the Phase 6 Section 106 Agreement and Battersea Project Land Company Limited and Thames Water Utilities Limited in respect of the phase 7 Section 106 agreement under Section 106 under the Town and Country Planning Act 1990, Section 16 of the Greater London Council (General Powers) Act 1974, Section 111 of the Local Government Act 1972 and Section 1 of the Localism Act 2011. The agreements would secure sums equal to the costs to carry out and complete works to construct the remainder of the Riverside Path and the Pedestrian and Cycle Routes as set out in the Eleventh Deed of Variation of the BPS S106 Agreement (the Section 106 Agreement). On completion of the agreements, the Existing Bond dated 22 April 2016 and secured in the S106 Agreement would be extinguished and could no longer be enforced by the Council.
