The proposed use is as an emergency solo children's home with two support staff in 8-hour shifts. The use is estimated to be for around 200 days per annum. This level of institutional use would be so similar in character to a private residential use that no material change of use would occur. For this reason, although the Use Class would change from C3 to C2 there would be no development requiring planning permission. The use would therefore be lawful.
