Deed of Variation to the Section 106 Legal Agreement relating to planning permission 21/P/1766/OUT (allowed at appeal ref: APP/DO121/W/21/3285624) to allow for 1) removal the requirement to let the SO units at a 40% market value of the initial share; 2) amend the rent from 1% rent of the retained equity to 1.5% (and capable of being increased annually by the rates as set out in the Rent Guidance); 3) amend the requirement to let the rented units at the Target Rent when the units are transferred to the RP to the Target Rent at the time of letting; 4) include a release provision for persons who have exercised a preserved right to buy; 5) remove or amend Paragraphs 4.4 and 4.5 of the First Schedule as they require the RP Transfer to contain specific covenants which are likely to affect chargeability.
