Modification of Section 106 Legal Agreement for planning permission 16/P/1677/OT2 to allow 1) amend the number of persons who can occupy the 2 bed flats from 4 persons to 3 persons; 2) amend the definition of "Transfer Price" so as to allow the rent on retained equity capped at 1% to be increased in line with the Index plus 0.5%; 3) Paragraph 3 and 5 of the Second Schedule contains the release and mortgagee in possession clauses - these need to be updated to the industry standard wording to facilitate charging; and 4) Paragraph 4.1.1 of Schedule 3 to make it explicit that the registered provider can be a member of the management company in its capacity as owner of the affordable housing units
