Deed of Variation to the Section 106 Agreement dated 20 December 2019 pursuant to planning application reference 17/505711/Hybrid:The amendments sought are set out as follows: - To insert an enforceability clause excluding liability from the RP and RP Mortgagee in respect of the non-AH obligations;- To amend the rent restrictions so that:o The rent on SO units can be increased by CPI + 1% instead of RPI + 0.5%;o The rent on AR units can be increased by CPI + 1% per annum;- To amend the initial share that can be purchased on a SO unit to between 10-75% in line with the new model for SO leases;- Removing references to HTB Agent;- To insert express reference to tenants who have exercised a preserved right to buy within the exclusions clause.- To amend the Mortgagee in Possession clause to ensure it is suitable for charging purposes
