Description

An application submitted under Section 96a of the Town & Country Planning Act 1990 for a non-material amendment in connection with the planning permission DC/21/123657 (Appeal Ref: APP/C5690/W/23/3325078) dated 12th June 2024, for the variation of Condition (4) Contamination in order to allow:- changes to the wording of the condition to allow discharge, specifically:(a) No development shall take place, including any works of demolition, until an assessment of the risks posed by any contamination, carried out in accordance with British Standard BS 10175: Investigation of potentially contaminated sites - Code of Practice and the Environment Agency's Model Procedures for the Management of Land Contamination (CLR 11) (or equivalent British Standard and Model Procedures if replaced), shall have been submitted to and approved in writing by the local planning authority. (b) If any contamination is found, a report specifying the measures to be taken, including the timescale, to remediate the site to render it suitable for the approved development shall be submitted to and approved in writing by the local planning authority. (c) The site shall be remediated in accordance with the approved measures and timescale, and a verification report shall be submitted to and approved in writing by the local planning authority prior to occupation of the development. (d) If during any works on the site, contamination is encountered which has not previously been identified ('the new contamination') the Council shall be notified immediately and the terms of paragraphs (a - c), shall apply to the new contamination.
