Deptford Landings S106 Agreement Discharge Schedule 3, Clause 1.33 - Off-Site Landscaping Work1.33 The Owner shall commission (at its own cost) and provide to the Council within 12 months of the Commencement Date:1.33.1 a survey of the land on which the Off-Site Landscaping Works are to be carried out;1.33.2 a specification and detailed design for the Off-Site Landscaping Works having regard to the survey referred to in paragraph 1.33.1 and based on the outline of works contained in Annexure 4; and1.33.3 a full schedule of costs (including a reasonable contingency) for the carrying out of the Off-Site Landscaping Works in accordance with the specification and detailed design provided under paragraph 1.33.2, such costs to be subject to the costs cap in paragraph 1.37.1.34 The specification and detailed design for the Off-Site Landscaping Works as submitted pursuant to paragraph 1.33.2 shall be subject to agreement with the Council and the Council and the Owner shall use Reasonable Endeavours to agree the said specification and detailed design and if the same are not agreed within 20
