Description

REAR (Ladywell House): ONE Yew (T9)(ht.8m) FALLEN. Reason: tree has fallen over and posing imminent danger, roots undermined by boundary wall rebuilding works. Replanting scheme to follow in subsequent application. Duty to replace applies (see informative A and condition 3 below)Informative A: Duty to replace applies if a tree in a conservation area is removed because it is dead or presents a risk of serious harm: Tree Preservation Orders and trees in conservation areas, guidance, para 121. A replacement yew tree is required, or other species to be agreed with the council. Informative B: the extent of ground excavation within the root protection area (RPA) of the yew tree in rebuilding a northern section of the rear garden boundary wall may have contributed to the demise of the yew tree.
