Individual trees are not specified in the TPO, they are grouped under "G1" which extends along the rear boundaries of multiple properties. I believe the tree that I am requesting works to is a "Hawthorn". I am not sure if this tree is covered within the TPO although I suspect it is.I propose to have my garden landscaped this summer which will include a new rear fence along my boundary which is where the tree is situated.I wish to be granted approval to fell the tree and replace it with several smaller Hawthorns in the same hedge line ~1m further away from the current tree. I will be guided by the council as to the size of the tree's to replace them with.The current tree has been a problem for my rear fence since we moved in ~4years ago.The tree is angled slightly towards the fence and has been gradually growing/leaning onto the fence and has caused damage to my fence each winter. 2 years ago during some wind, the tree movement caused a fence post to snap. This was replaced but was broken again during high winds in 2022. Earlier this year, the high winds and tree movement cause the fence post to snap yet again. The fence post was unable to be placed in the same position again due to the tree movement and a new fence post was placed off center to the original boundary so that the fence could be put up around the tree resulting in a slightly wonky boundary fence.The tree has already made contact with the fence again and I am reluctant to pay for a few rear fence as part of the landscaping knowing that it will likely be damaged and need repairing again. I am considering extending my fence boundary out by ~60-70cm in line with my other neighbors.The current position of this tree is such that it interferes with the fence of my current boundary and will also interfere with the fence if I extended my boundary slightly.
