Variation of Legal Agreement - The obligation the owner is seeking to remove the obligation that relates to the commercial buildings to be constructed. Despite advertising the commercial units, no interest has been shown and the commercial units have not been constructed. The owner has therefore submitted a new application in respect of the land reference DC/23/0014/FUL to erect five dwellings on the same land that had been set aside for the commercial units. The Council has requested that we submit an application and a deed of variation to vary the S106 Agreement attached to permission DC/13/3229/OUT.
