Description

EXPP: A declaration is sought under Section 5 of the Planning and Development Act 2000 (as amended) to determine whether the continued use of the premises as a preschool constitutes exempted development, having regard to: i) the continuous and long established operation of the preschool for over two decades; ii) the fact that planning permission for such use was not required at the time of commencement; iii) the absence of any material change in the character or intensity of use over time; iv) the existence of a valid fire safety certificate issued by Dublin City Council and; v) the relevant provisions of the Planning and Development Regulations 2001 (as amended) concerning exempted development.
