Description
LAW: In accordance with Article 81A (1) of the Planning and Development Regulations 2001 (as amended), notice is hereby given that the Land Development Agency on behalf of (and pursuant to a contract entered into by) Dublin City Council intends to carry out a 'housing development' as defined by Section 179A(5) of the Planning and Development Act 2000 (as amended). The development is proposed at a site of 0.7574 hectares that is principally bound by : Oscar Traynor Road to the north-east, Kilmore Road to the south-east, Cromcastle Road to the south-west and the grounds of the HSE Primary Care Centre to the north-west in Dublin 5. The site also includes part of Cromcastle Road for road junction and water service connection works. The proposed development will principally comprise of: -the demolition and removal of existing boundary walls, railing and ESB mini-pillar, and the construction of 146 No. apartment units (13 No. studios, 54 No. 1-bed, 67 No. 2-bed and 12 No. 3-bed) and 2 No. community/culture units (totalling 479.3 sq.m.). The development (15,280.5sq.m. gross floor area) will be contained in 3 No. blocks (A, B and C), ranging in height from 1 No. storey to 8 No. storeys (including semi-basement/podium level), as follows: -Block A will be 6 No. storeys (including semi-basement/podium level), Block B will range from 1 No. to 8 No. storeys (including semi-basement/podium level), and Block C will be 3 No. storeys. The development also proposes the following: a new multi-modal entrance/exit at Cromcastle Road; 103 No. car parking spaces; 5 No. motorcycle parking spaces; cycle parking; hard and soft landscaping including public open space, communal amenity space and private amenity spaces (as balconies and terraces facing all directions); boundary treatments; plant and communications rooms, double sub-station; bin store; lighting; blue-green roofs; rooftop PV arrays; lift overruns; 6 No. microwave dishes attached to 3 No. support poles affixed to the lift overrun of Block B; and all associated works above and below ground. In accordance with Article 81A (5) of the Planning and Development Regulations 2001 (as amended) Dublin City Council, as the competent authority, has carried out Environmental Impact Assessment (EIA) Screening and has determined that there is no likelihood of significant effects on the environment arising from the proposed development and that an EIA is not required in respect of the proposed development. In accordance with Article 81A(6) of the Planning and Development Regulations 2001 (as amended) Dublin City Council, as the competent authority, has carried out Appropriate Assessment (AA) Screening in respect of the proposed development to assess, in view of best scientific knowledge, if the development, individually or in combination with other plans or projects, would be likely to have a significant effect on a European site in view of its conservation objectives. Accordingly, Dublin City Council has determined that the proposed development would not be likely to have a significant effect on a European site and that a Stage 2 Appropriate Assessment is not required in respect of the proposed development. Plans and particulars of the proposed development, including the determinations made under Articles 81A (5) and 81A (6) of the Planning and Development Regulations 2001 (as amended), may be inspected or purchased at a fee not exceeding the reasonable cost of making a copy, at the offices of Dublin City Council, Planning Department, Block 4, Ground Floor, Civic Offices, Wood Quay, Dublin 8 during its public opening hours (9.00a.m. - 4.30p.m.). The plans and particulars, including the determinations, are also available to view online at: https://consultation.dublincity.ie/ A person may question the validity of any decision of the planning authority by way of an application for judicial review under Order 84 of the Rules of the Superior Courts, in accordance with Sections 50 and 50A of the Planning and Development Act 2000 (as amended) within the period of 8 weeks from the date of publication of this newspaper notice.
