Description

1. Natural grade rear gardens to the rear of plots 1-19 (approved fill at top of embankment along northern boundary no longer required) 2. Change of fence type at top of embankment along northern boundary 3. Low level decks to the rear of plots 17 and 19 Reason for changes: Conditions 3 and 4 of planning approval LA11/2016/0976/F (approved at appeal 2020/A0151 on 25 January 2022) require the submission to and approval of a written report by the council on the final design solution to ensure slope stability along the northern boundary of the application site along with details of temporary and permanent works for slope retention. The applicant is currently in the process of discharging these conditions with the council (ref LA11/2023/1771/DC). As part of the condition discharge application, it has been determined that the first slope stability solution proposed required the control of lands outside of the application site and is not therefore workable. An amended solution has been submitted under the condition discharge application which has removed the fill proposed in the rear gardens along the northern site boundary. Accordingly, this NMC application seeks to update the drawings approved at appeal 2020/A0151 to remove the fill in the rear gardens to the rear of plots 1-19 with updated drawings showing the rear gardens and site sections reverting back to the original ground levels in order to facilitate the discharge of conditions 3 and 4.
