Description

Prior Approval - The proposal is to import 30,000m3 / 66,000 tonnes of inert soils for the remodelling and construction works. The quantity of material was calculated from cut and fill survey plans at a conversion ratio of 2.2 tonnes to 1m3, which allows for compaction and settlement. All landscaping works will be completed using imported inert soils, subject to an Environmental Permit for recovery. The Town and Country Planning Act 1990 (TCPA) part 6 Class A states that any excavation or engineering operations undertaken on agricultural land in an agricultural unit of 5 hectares or more would constitute permitted development. In addition the growing of turf has been found to constitute agricultural use (appeal cases of Somerset 29/8/1997 and North Kesteven 26/4/1994) so this would be permitted on the site under Part 6 Class A of the GPDO 2015
