Description
Modification of Section 106 (18/00792/OUT) progress a Deed of Variation to the attached Section 106 Agreement, dated 11 September 2019. The amendments we are seeking are set out as follows: •To insert a clause excluding liability from the RP and their mortgagee in respect of the non-affordable housing obligations; •To amend the MIP clause to ensure the affordable units can be charged at MVST; •To include a provision permitting the rents on affordable rented units to be increased by CPI + 1% per annum; •To insert a clause excluding liability from the mortgagees of owner-occupiers or tenants of dwellings in respect of the obligations in the s.106; •Amend the share that can be purchased on SO units from 25-75% to 10-75% of the open market value; •To rectify the clause numbering in the occupation restrictions at Paragraph 1.3; •Remove reference from HTB Agent as it is no longer in existence; and •Include reference to the preserved right to buy at paragraph 5
