The tree is situated in the garden of a long term rental property and the continued decay of the tree and the potential risk it imposes upon existing and/or future tenants (in the event of stem or root failure) presents an unnecessary and increased burden of care and liability upon the land owner. Despite the obvious amenity value of the tree, the land owner would prefer to remove the tree so as to eliminate the possibility of causing injury or damage that could reasonably occur in the event of complete stem or root failure.
