Certificate of Existing Lawful Development to establish works carried out in respect of the demolition of the buildings and associated remediation of the land (the Works) is lawful being development permitted by planning permission 17/6714/EIA for the Waste Transfer Station and falling within the definition of a material operation within the Town and Country Planning Act 1990 which in accordance with Section 56 (4) of the Act and that sufficient works were undertaken to begin the development of the Waste Transfer Station within three years as required by Condition 1 of planning permission 17/6714/EIA. All necessary Pre-commencement conditions have been discharged for the Works including Condition 9 (Demolition and Construction Environmental Management Plan) (reference 19/3046/CON); Condition 10 (Construction Transport Management Plan) (reference 19/0241/CON); Condition 17 (Humber Road Arrangements) (reference 19/0242/CON); and Condition 32 Part 1 (a&b) (Contamination Remediation Strategy) (reference 19/0243/CON), Condition 32 Part 2 (c) (Contamination Remediation Validation Report) (reference 22/3982/CON). The Works have subsequently been undertaken in accordance with such approvals and completed before the expiration date in Condition 1 on the decision notice of 17/6714/EIA.
