Application for the Modification of Section 106 Planning Obligation relating to 3563/15 to amend MIP clause to ensure the affordable units can be charged at MVST. Include enforceability clause excluding liability from the RP and RP Mortgagee in respect of the non-AH obligations. Amend clause 2.9 to include mortgagees and successors in title and individual purchasers, lessees and tenants. Remove staircasing cap on shared ownership units. Amend s.106 to account for the additional unit being acquired. Amend initial % that can be purchased on a SO unit from 10-75% of the open market value. Amend exclusions clause so tenants who have exercised a right to buy / preserved right to buy are excluded from the AH obligations.
