Application for the Modification of Section 106 Planning Obligation dated 11 February 2021 relating to DC/19/02878 - Amend the Mortgagee in Possession clause using the NHF pro-forma wording so this is suitable for charging at MVS;. Amend so Affordable Rented units can be increased by Consumer Price Index plus 1%; Amend the enforceability clause at 2.9 so that a RP and mortgagees of all parties will also not be liable for the non-affordable housing obligation;. Amend so shared ownership units can be leased at a premium between 10-75% on first purchase of the equitable interest to comply with the new Homes England model lease; Amend the exclusion clause at Schedule 2 Paragraph 1.8 so that someone who has exercised the right to buy or preserved right to buy in relation to an affordable housing unit can also be excluded from the affordable housing obligations.
