Discharge of Conditions in relation to LA08/2024/0400/F. Condition No. 8 states: "The construction of the development approved herein shall not commence until a final hard and soft landscape and open space management and maintenance plan has been submitted to and approved by the Council in writing. The plan shall set out the period of the plan, long term objectives, management responsibilities, performance measures and maintenance schedules of all areas of landscaping and open space as shown on Drawing No.28A. It shall also set out details of the arrangements that will be put in place for the future management and maintenance in perpetuity of these areas, including details of the legal agreement, between the prospective residents and Management Company, which are to be put in place as per Policy OS2 of PPS 8. The landscape and open space management plan shall be carried out as approved unless prior written consent is granted by the Council for any variation." Condition No. 24 states: No development shall take place until a landscaping plan showing full details of all proposed tree and shrub planting within the area of buffer planting located to the rear of the dwellings on sites 33-38, identified on drawing no.23A, has been submitted and approved in writing by the Planning Authority. The landscaping plan shall include the species, size at time of planting, location, spacing and numbers of all trees and shrubs to be planted and the proposed time of planting and all tree and shrub planting shall be carried out in accordance with those details and at those times. Trees or shrubs dying, removed or becoming seriously damaged within five years of being planted shall be replaced in the next planting season with others of a similar size and species unless the Planning Authority gives written consent to any variation."
