Discharge of Conditions 3, 4 & 5 of LA08/2022/0847/F. Condition 3 states: "No development activity, including ground preparation or vegetation clearance, shall take place until a protection zone(s), clearly marked with posts joined with hazard warning tape, has been provided around each badger sett entrance at a radius of 25 metres (as per Figure 2, Badgers Setts drawing) No works, vegetation clearance, disturbance by machinery, dumping or storage of materials shall take place within the protection zone(s) without the consent of the Planning Authority/unless an appropriate Wildlife Licence has been obtained from NIEA. The protection zone(s) shall be retained and maintained until all activity has been completed on site." Condition 4 states: "No development activity, including ground preparation or vegetation clearance, shall take place until a competent ecologist has been appointed as an Ecological Clerk of Works (ECoW) and the details, roles and responsibilities of the ECoW submitted to, and agreed in writing by, the Planning Authority." Condition 5 states: "Within 3 months of the decision notice herein granted, a programme of works shall be submitted to and agreed in writing with the Council to include confirmation of the exact locations of the pole locations and measures undertaken to ensure that all recorded sites and monuments were avoided."
