Proposed Discharge of Condition nos.9 and 11 of Planning Approval Ref.LA08/2022/1200/F The hard and soft landscaping works shall be carried out in accordance details to be submitted to and approved by the Planning Authority in writing. The hard landscaping and works shall be carried prior to the occupation of the first dwelling and the soft landscaping works shall be carried out in first available planting season following occupation of the first dwelling, or in in accordance with a programme of works to be submitted to and approved in writing by the Council. If within a period of 5 years from the date the development is completed, any tree, shrub or hedge is removed, uprooted, destroyed, dies, or becomes, in the opinion of the Council, seriously damaged or defective, another tree, shrub, or hedge of the same species and size as that originally planted shall be planted in the next planting season at the same place, unless the Council gives written consent to any variation. The construction of the development approved herein shall not commence until a hard and soft landscape and open space management and maintenance plan has been submitted to and approved by the Council. The plan shall set out the period of the plan, long term objectives, management responsibilities, performance measures and maintenance schedules of all areas of landscaping and open space. It shall also set out details of the arrangements that will be put in place for the future management and maintenance in perpetuity of these areas, including details of the legal agreement, between the prospective residents and Management Company, which are to be put in place as per policy OS 2 of PPS 8. The landscape and open space management plan shall be carried out as approved.
