Description

Reprofiling of agricultural land through infilling with imported inert material (drainage scheme) with access onto Moss Road, Newtownards - Variation of Condition 8 from 'There shall be no site clearance or development activity within 25m of the badger sett outlier 2 (as identified within the badger survey submitted and as shown on the badger survey map, figure 5) until evidence has been provided to the Council for agreement in writing that the badgers have been excluded and the setts have been closed under the terms of a license issued by the Northern Ireland Environment Agency' to 'There shall be no site clearance or development activity within 25m of the badger sett outlier 1 (as identified within the badger survey submitted and as shown on the badger survey map, figure 5, until evidence has been provided to the Council for agreement in writing that the badgers have been excluded and the setts have been closed under the terms of a license issued by the Northern Ireland Environment Agency'. Variation of Condition 9 from 'No development activity, including ground preparation or vegetation clearance, shall take place until a protection zone, clearly marked with posts joined with hazard warning tape, has been provided around Outlier 1 sett entrance at a radius of 25m (as identified on the badger survey map, Figure 5). No works, vegetation clearance, disturbance by machinery, dumping or storage of materials shall take place within the protection zone without the consent of the Council or unless an appropriate Wildlife Licence has been obtained from NIEA.
