Description
Discharge of condition 9 and 11 of LA06/2021/1257/F: 9. Prior to the occupation of the proposed development, the applicant shall submit a Verification Report to the Council for approval in writing. This report shall demonstrate that the remediation measures outlined in the report titled; A Contamination Assessment & Remediation Strategy, 112 Comber Road Ballygowan prepared by Pentland Macdonald Ltd Report No. PM16- 1126 and dated December 2017 have been incorporated into the development. The Verification Report shall demonstrate the successful completion of remediation works and that the site is now fit for end-use. It must demonstrate that the identified potential pollutant linkages are effectively broken. The Verification Report shall be in accordance with current best practice and guidance as outlined by the Environment Agency. In particular, this Verification Report shall demonstrate that: (a) The emplacement of a 1m thick capping layer across all gardens comprising: • A geotextile membrane (or equivalent) at the base of the capping layer, which shall be water permeable, rot proof, chemically resistant and have a high tensile strength. Parallel layers shall be suitably secured or overlapped by at least 0.2m. • A capillary layer comprising of at least 300mm of granular material overlain by a total of 700mm of demonstrably proven suitable subsoil and topsoil overlying the geotextile membrane to be completed across all garden areas. (b) The emplacement of a 0.6m thick capping layer across all landscaped areas comprising: • The emplacement of a geotextile membrane (or equivalent) at the base of the capping layer, which shall be water permeable, rot proof, chemically resistant and have a high tensile strength. Parallel layers shall be suitably secured or overlapped by at least 0.2m. • A layer comprising of at least 600mm of demonstrably proven suitable clean gravel/ subsoil and topsoil overlying the geotextile membrane to be completed across all landscaped areas. (c) All soils re-used or brought on the site to create the capping layer shall be accompanied by traceability documentation and shall be demonstrably proven to be suitable for the end use. Reason: To ensure the site is fit for end use in the interests of public health. 11. After completing the remediation works under Condition 9; and prior to occupation of the development, a verification report shall be submitted to and agreed with the Council in writing. This report shall be completed by competent persons in accordance with the Land Contamination: Risk Management (LCRM) guidance available at https://www.gov.uk/guidance/landcontamination-how-to-manage-the-risks. The verification report shall present all the remediation, waste management and monitoring works undertaken and demonstrate the effectiveness of the works in managing all the risks and wastes in achieving the remedial objectives. Reason: Protection of environmental receptors to ensure the site is suitable for use.
