Description

Discharge of Condition numbers 11 & 12 under planning permission ref: LA06/2020/0187/F: Discharge of condition 11 - If during the development works, new contamination or risks are encountered which have not previously been identified, works shall cease and the Council shall be notified immediately. This new contamination shall be fully investigated in accordance with the Land Contamination: Risk Management (LCRM) guidance. In the event of unacceptable risks being identified, a Remediation Strategy shall be agreed with the Council in writing, and subsequently implemented and verified to its satisfaction. This strategy shall be completed by competent persons in accordance with the Land Contamination: Risk Management (LCRM) guidance. Reason: Protection of environmental receptors to ensure the site is suitable for use and protection of human health. Discharge of condition 12 - After completing the remediation works under Conditions 10 and 11 and prior to occupation of the development, a Verification Report shall be submitted to and agreed in writing by the Council. This report shall be completed by competent persons in accordance with the Land Contamination: Risk Management (LCRM) guidance. The Verification Report shall present all the remedial measures outlined in the Preliminary and Generic Quantitative Risk Assessment, prepared by WYG Environmental, referenced A112779-2 and dated February 2020 have been implemented and demonstrate the effectiveness of the works in managing all the risks and achieving the remedial objectives. In particular, it shall demonstrate that the asbestos contamination has been addressed by providing evidence that the proposed capping layers have been laid in the required areas to specific depths with demonstrably proven suitable material. The Verification Report shall also ensure to verify fully any waste management movements from the subject site in relation to remediation works undertaken. Reason: Protection of environmental receptors to ensure the site is suitable for use and protection of human health.
